Real Estate transactions in Mexico are much more complex and cost demanding than in other countries, especially for foreign investors.
Constitutional prohibitions impede foreign individuals or entities to acquire direct title over real estate properties located in the Restricted Area (100 kilometers along the borders and 50 kilometers along the seashores): however indirect title can be acquired through Fideicomisos (Bank Trusts) or Mexican Entities.

Mandatory regulations demand all Real Estate transactions be formalized by Notaries, through the obtaining of several government certified documentation and the compliance of related legal and tax regulations.
Notaries are government appointed officers. They are limited to observe only the basic standard regulatory formalities, being impeded to act on behalf nor represent neither party involved in the transactions they formalize.

Unlike the U.S., Canada, and other countries, Real Estate agents in Mexico, except for some territories, lack of governance and do not require professional licensing. And in those States with some regulatory structure, licensing and supervision processes are still very lacking. In practice, anyone can work as a real estate agent in Mexico, whether having or not professional education on the basic legal and tax implications associated to real estate transactions.
